Very worried.....what happens if employer does not comply with order?

My ex husband used to pay child maintenance via a prior arrangement which he made according to advice from his solicitor.

Suddenly he decided to stop paying it and I have had no money for the children since November. I applied to the CSA and he was non-compliant with them all the way through and they even had to chase his employer to get his earnings information.

I had a payment schedule from the CSA which stated that they should have taken the first payment from January. The employer apparently has until 19th February to send it.

Because they have been so non-compliant I am starting to panic that they are not going to send it - so far they haven't....

Does this happen often?? I was wondering if anyone has any insight into what happens next if the employer doesn't comply with the order. It is the NHS so I'm rather shocked that an organisation like that would not comply.

    Well its only the 11th, do you know when your ex gets paid? And if it is going to the csa first and then they are paying you it might take a bit longer.... Just hold in there! I'm sure it will come through. :)

    We're in this situation at the moment with the NRP - seems that she has made friends with someone in payroll and asked them not to send the payment as she was going on holiday and wanted some spending money :eek:

    Apparently the next step is for the CSA to send an inspector to her workplace. We had to chase hard for them to agree to do that though and so far have had no report or response back from them to confirm they've done it (and no money received yet either).

    Looking at your dates though i believe the CSA will hold the payment for 2 weeks at least after the due date of 19th February, before transferring it to you. So you would probably get it by end of February or early March.

    I have the same problem. Payment never comes through unless I chase it up. Now I phone the CSA around the 24th of each month. They confirm that payment has not come through and phone the employer. A few days later I phone the CSA again to check that they have the payment and usually they have after 'reminding' the employer.

    It's a pain having to do this, but as I was told by the CSA, they don't have staff checking all the payments, so unless I alert them to the fact that it hasn't been sent in by the employer, they wouldn't even notice!

    I have sent in a complaint as the last 4 out of 5 payments have been late and I now feel that the CSA should take action (£1000 fine I believe) against the employer. After a month, I still have not received a reply, so will shortly be contacting ICE re. this matter.
  • Dont count your chickens with them complying after a visit or fine either- Ive been doing this the last 6 yrs-- and they are still habitually late, been down the ICE route with it aswell..to no avail- short of standing outside the workplace with a plaquard reminding them to send ive given up and just scream instead..

    Thanks for replies - so I see this will be the shape of things to come. Wobblebottom - you have never had any money yet???? What the hell is the point of the CSA - I'm beginning to wonder...

    I wouldn't worry too much. There is no way that he NHS will be non-compliant. They do have until the 19th of the month to pay, and even then it doesn't go straight into you bank. The money does the rounds, firstly through the CSA before you get it. Just hang tight, it will appear yt. Mind you, depending on how the CSA are managing it, it wouldn't be a bad idea to give them a call ( after 19 Feb) to make sure that it has been processed. It wouldn't be the first time that someone's money has been left swashing about in the CSA coffers.

  • op i would give them a call on the 19th and ask that the employer is contacted to get details of the payment being received - because almost all deo payments are received around the 19th it can take up to a week for the payment to actually be allocated to your case especially with a large employer like the nhs as they will usually send a bulk payment for many nrp's which has to be allocated to many cases. but if you know its def been sent then its just a waiting game
