Help needed with Bank Charge Debts

Hey Everyone,

I'm looking for some advice. Recently Westcot Credit over a debt from 2007

Basically I had a basic fles account with Nationwide which had a direct debit charge on it for an unpaid direct debit, I cleared the amount of the direct debit but refused to pay the bank charge as it was when the whole bank re-claiming charges thing was starting off.

They kept adding and adding charges on it and eventually I complained and tried to reclaim my charges. They said they wouldn't repay them as they had already refunded charges on my other account.

At the time i stupidly never did anythign about it and it spiraled to £277 before it was defaulted.

I never ever received notification of the default, i first noticed it on my Credit history.

In 2008 Westcot tried to harass my into paying it despite the fact I told them the account was in dispute with Nationwide.

Now they are hounding me every day by phone trying to get me to repay the debt.

I have no idea what to do, part of me refuses to pay the debt as its 100% bank charges, but the other part of me is worried this is going to affect my remortage in August this year.

I have read the new bank reclaiming guide but I'm not sure how to progress or what to do.

Can anyone help or give me some advice, I already have a debt management plan with payplan so all my excess income is tied to that.

  • If they have put a default on your credit file, it will affect your mortgage.
    If you pay it off, it will be a settled default, but still it will have an affect.

    You aim is to keep your file free of any Defaults, CCJs or other court action.

    The first thing you need to do is find a way of getting the default removed, this is a CCA version, but it might apply in some form, never in doubt might be able to advise further on removal of defaults when no paperwork was sent out - http://forums.moneysavingexpert.com/showthread.html?p=26867889#post26867889

    As to reclaiming, your best bet is to try the reclaim forums.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
