Over Paid salary

Advice needed.
Got head hunted back last june '09 to go work for agency that worked within my company and they offered me a job at higher rate of pay and promised lots of training etc. They told me there were lot's of oppurtunitys for extra training and progressing to higher level's etc
I took the job and after 2weeks they called a meeting with all their other workers and dropped the bombshell they were making me and one other lady redundant as funding had been withdrawn for our posts.! Ever since then the company I originally worked for are going through TUPE paperwork to see if I and the other lady can be Tuped accross to them - in meantime they keep extending redundancy notice 3 months at a time.
When i received my first salary 4 weeks after i started I noticed it was slightly higher than it should be - but with redundancy impending I thought "stuff" them so kept quiet. In december they found their error and called me to tell me they had made a mistake and asked for their money back - now I didn't break into any of the overpayment but my bank has sucked it up to pay back my overdraft. So I told them this and have agreed to pay 20% of my monthly wages. I'm waiting to hear if they will except this.
My query is am I liable for the Total of the Gross amount or the Net amount - they say the gross amount??

I'm no expert but I would you would owe them gross but be eligible to reclaim the tax. Best to ask for advice on the cutting tax board0

Whatever the amount they overpaid into your account is the amount that should be repaid. Not sure if you need to contact the tax office to get back any overpaid tax and NI contributions. Thanks George - its just that i thought as its all in the same tax yr they should adjust their final payments to the HMRC in which case I'd owe the net amount??0
