debt collector

hi new here dont know if i am posting this in the write place!!!!!!

need HELP fast

i just got back from town to find a balliffs letter stuck on my car!!!! saying that i cannot remove the car because they are going to sell it at a public auction!

the full story is!

i used to live with friends who got into debt with there landlord it went to court and they lost the court ordered that they pay £850 to the landlord! because i was living with them i think that they have me as a jiont tennant!

the balliffs letter is in my friends name and showin there debt so why stick it on my car i am not related to them have nothing to do with them anymore!

can the balliffs do this! to me they shouldnt b allowed because its not my debt! they are going to take my car to pay there debt!!!!!!

can some1 help please!!!! dont wanna loose my car!!!!!! :(

  • if it was me personally, id just drive off. chuck the letter in the bin and have nothing to do with it. Its not you, and don't waste your money and time telling them ( the ballifs. )

  • You need to find out if you where named as a defendant on the claim ASAP, if not, they can not touch your property, but if you where named on the court claim, that makes all the differance

    Was the car outside your property? does your friend live with you at this address?

    See the above - well clearly of the note on your car is not in your name then the car does not belong to the person they are after.

    Therefore your friend should write to them to say they do not own the car that has been leived. If they won't then I would write to them myself, if you don't they could well seize it (even if they find it elsewhere another day)

  • If the bailiffs have the right to sell the car at auction - they would have removed it there and then! They are being asses - contact them or the council dept for them and ask them what the debt is for an who owes it. If it aint you, they cant take anything, and at least, not without a court order anyway - the !!!!!!!

    No they would not take it there and then, not always;) they would prefer cash, less work, so would use the threat as leverage.

    We dont even know if the car will cover the cost of taking it, let alone selling it, from this thread anyway, just something to think about

  • thanks for all the advice guys! the car is worth loads more than £850 so they would get loads more than they owe lol! rung them earlier an if they can c a copy of the log book they will leave it alone and try looking for the EX friends again! luckly enough i got a new log book last month cause i lost mine lol! ;)
