Loan not signed or dated. Sorting finances out

We are in a bit of a pickle where finances are concerned. The good thing is at the present time we are still able to meet our bills and hopefully in a couple of months hopefully start to make larger payments to clear things quicker.

Upon going through our paperwork today its the first time I have noticed that my husbands and I joint personal loan with Blackhorse has not been dated at all. No starting date, ending date not even the date that the agreement was made. Our signatures are there but whoever processed our loan has not signed it. I was wanting to check how long is left before it was paid off. Is this a common thing to happen? Is it legal having no dates completed?

I would appreciate some feedback.

    I'm afraid I don't know about the legalities of it. However I did just check my RBS loan. The actual "fixed-sum loan agreement" doesn't have any dates or signatures, just the term (ie. how much I'm borrowing over x amount of months.) The document states it's the "customer's copy - 2nd copy". As I'm sure I signed something, I'm guessing the original is with the bank.

    It does however have a covering letter with the start date.

    Perhaps check it out with the copy concerned? I keep track of mine online now, I find that helps.

    thanks for your reply and welcome.

    I have just had another look at my paperwork, I seem to have 2 copies of "Borrowers first copy". The other thing I have is the paperwork for setting DD to my bank just noticed that this isnt signed either.

    That does seem odd! Is it a fairly new loan? Have you checked whether any payments have been made to it yet?

    Hi again,

    not 100% certain but I think the date we took the loan would be April or May 2007. Yes the money has been coming out every month since then. Wonder if I should post a message in the Unenforceability & Template Letters II thread after having a look there?

    you may be better posting this on the loan forum. Most there may know what to do.
    I have found faults with a lot of paperwork most is very faded or missing!!
