Hi All
Have read all the previous posts on this outfit with interest.
My fiance is now on the '72 hours to respond' threat letter over a £770-odd bill from Tiscali.
The situation was as follows:
His ex-wife and two daughters had Tiscali in the house, but it didn't work properly, so they just contacted another ISP provider, and never cancelled the Tiscali one, and the bill kept adding up. We disputed it with Tiscali, as we believe they failed in the care of duty, by not suspending the account and limiting our liability. They also failed to provide us with copies of the accounts proving the debt was genuine. This was all back in 2007, and we heard nothing further from Tiscali.
We now have these demands from Roxburgh. I am sending the telephone harrassment letter, and also a letter asking them to prove the debt, or stop harrassing us. I have checked my fiance's experian file, and there is no mention of a debt to Tiscali (or Talk Talk, or Roxburgh) listed.
Roxburghe are also threatening a ‘doorstep visit’, which makes us uncomfortable, as only his ex-wife and two daughters live at the address in question. I have also therefore informed Roxburghe that:
“Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.
Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance”
Any other ideas as to what to do next??
Sorry for the long post…….
