Can DCAs not read?

If any of you remember a few weeks ago I sent all of my creditors a letter with £1 postal order requesting my credit agreement and most importantly the deed of assignment. I did this because they are just impossible to deal with, ignore my letters, send random letters to me, I respond they ignore me... so the cycle goes on. So, I wanted to find out who owned my debts and who were acting as collection agencies. I haven't had a reply from any (now approaching 30 days).

Today I recieved a letter from one creditor saying. That they acknowledge the £1 payment on my account but this isn't enough, they require £78 per month :wall:

My question: CAN THESE PEOPLE NOT READ? :confused: I wasn't paying £1 off my account, I am paying more than that currently! My letter clearly expalined what the payment was for.

For the record I am still paying them on my self set up payment plan (one which they didn't agree or disagree to, they just ignored it and sent me another random letter!:doh:

    I dont think its a question of whether they can read. its whether they want to understand, which lets face it most dont.

    Has the 30 day period expired? Can you not go onto stage 2 now?

    Hi Annie... I never quite figured out what stage 2 was, the advice even from national debtline all gets a bit fuzzy after the 30 days expires. 30 days is coming up, I will check my paperwork when I unpack it (it's in a box, in a van ready to go to the new house this afternoon).

    I'm sure these people are really very clever and playing some bizarre psychological game with me... can't figure out what it is. Right now my stage 2 plan seems to be a letter back saying STOP BEING SILLY. Maybe that would work:confused:

    I responded to your post and advised you that you are not entitled to the deed of assignment and to read the first letters you were sent by the dca's which will tell you if they have bought it or are collecting on behalf of the lender.

    If I had recieved any such letter Tootsie I wouldn't be doing this. The only letters I have ever had are ones demanding payment and threatening court action. Only one of my creditors has written to me telling me the debt was sold. The others... I have no idea.

    And, for the record it was payplan who advised me to request the deed of assignments.

    Dig out the first letter you were sent by each of the dca's. In addition to chasing you for the money it will either say - 'we have been instructed by/we are collecting on behalf of/or similar OR we have bought/sold the debt.

    IMO it's actually a trick the DCA use to try to reset the clock as it were. the DCAs are well aware that if there is no payment nor acknowledgement of the debt for 6 years then the debt, whilst still owed, is no longer legally enforceable, no matter what threats they make. which is why they conveniently ignore the letter and claim it as a payment.

    Hopefully you kept a copy of the letter and sent it recorded. when the DPA time limit is up you should be able to escalate it. if enough people complain to the ombudsman / information commissioner etc then something will eventually be done to close down the rogue DCAs who attempt to ignore their industry regulations.

    Hey Toto. Can't offer any practical advice, but just wanted to stay stick at it. It can get so frustrating fighting faceless and incompetent bureaocracy (sp?) but at least YOU have a soul!!!!!!! :shrug: Tootsie - surely if they can't meet Toto's request they can write back (returning her postal order) and say so!!!

    Well on the face of it it seems easy, in practise though it is not.

    Have you ever worked in a post room ? They get thousands and thousands of mail items each day all of which have to be opened in a secure room with at least 2 people present. At this stage the money is seperated from the letter and applied to the account number given (again for security purposes), the letter is then passed on to the collections area and (hopefully) dealt with appropriately.

    I've never had a letter saying bought/sold. Do they have to offer that information then?
