Carcraft sold me an unvalid guarantee

Hi all...I'm new on here. But basically, I bought a car on finance from Carcraft in Feb 2009. Whilst getting bombarded by a sales rep, he told me that the car came with a full service history....when I signed the paperwork for the car the sales rep advised me of an optional guarantee called an NAC which covers the car for all mechanical faluts, mostly covers everything for the duration of the car finance. The validilty is based on.
  • full service history
  • or if not a full service history then a service after 6 months or 6,000 miles whichever is sooner.
When I stated to the sales rep that I did not want this service he pushed me into it, stating that it only costed blah blah blah

Again he told me that the car had full service history. My car's fan belt snap in December 2009 and it shattered the water pump in the process. Contacted the NAC/Carcraft and was told that the service history for the car was not full, hence making the guarantee void. I am paying and extra £22.00 a month for the duration of the loan for a guarantee that is void.!! Is there any thing I cann do to reclaim/stop the payments????

    I am guessing the service history was up to date when you bought it but you didnt get it serviced since? Getting the car serviced should bring this up to date but wont cover the previous failure.

    No I was told at the time of purchase that the service history was up to date. But when I checked it, it was not.

    You didn't check the FSH at the time then? I wish you luck proving they ripped you off, but you haven't really helped yourself out here.

    The car was last serviced in 2004 the year it was made, but I was told at the time I bought it that it was fully up to date this was in 2009!!

    Your word against theirs. I think you're legally right, but of course you have absolutely no proof whatsoever.

    EDIT: Oh sorry, I'm being daft, there is enough proof. They're the ones who sold you the guarantee, effectively saying "This guarantee is valid given the car we are selling you." So even if they don't admit that they said it had full service history, they will still have to honour the guarantee.

    Well if the garage now admit they last time the car was serviced was in 2004 and they sold it to you on the basis that it had a full service history you should be looking for compensation as the car was not as described. Are NCA claiming that your warantee would have been vaild if your serviced it within 6 months or are they sayng it was never vaild as the car hadn't been serviced in 5yrs?

    I have spoken to the people at Carcraft where I bought the car and NAC the guarantee providers...both of them are the same company!!! All I want to do is stop paying the £22.00 extra on top of my original financal agreement and maybe get some of the money I have already paid back. Surely whoever is in the wrong the fact still remains that the guarantee is now void. So therefore I should not be still paying for it...??
  • If you bring the servicing up to date then you can make future claims or have I missed something?
    Do you have any documentation from Carcraft showing the service history of the car? If not you stand no chance on this IMO.
