Mortgage Equity Rights

Hi

My Boyfriend took out a mortgage on a house with his ex-girlfriend and 2 years ago he had spilt up from her, he moved out to his mums but still continued to pay for the mortgage to avoid her struggling, he has now asked to have his name removed from the house but she has refused this. Also they had taken a loan out together of the value of £20,000 and has an arrangement to pay his half - she has refused to pay her half which means he will have to pay the full outstanding balance.
Whilst being spiteful she gave away his full pedigree Rottweiler for free to a stranger who had an interest on the dog.

He wanted to know if he is entitiled to half of the house as his name is still on the deeds, plus he paid most of the mortage himself, surely if he is forced to pay his side of things off he should be entitiled to something. Please advise

    if the mortgage was applied for in joint names then they own it jointly so therefore he owns 50%.

    but this part about paying half the debt wither on the mortgage or loan is irrelevant, he is liable for the full amount on both and only paying half will effect his credit and cause him problems in the future getting a mortgage.
  • We spoke to his account manager as he took a second mortage out with welcome fiance when he was living at the property and now that they have spilt up, he moved out in jan 2008 continued to repay the loan since jan 2008 and has not once missed a payment however she is still living there and is refusing to pay causing arreas on both their names,
    he understands that if she fails to pay he is still reliable for the full amount, he doesnt want his credit affected but debt collectors have been to her property but she is refusing to let them in, he was told they can not reposses the house because he is still making payments but if he stops it will affect his credit. the loan was for 20k and has already paid 6k but wasnt aware it was the arreas that he was paying back the loan now is 23k and he feels like he is fighting a losing battle and is unfair as she is living at the property

  • lol no i dont think so, shes already playing happy families with her new fella and her 16year old kid plus there is no chance she would ever move out,
    besides if he moved in back with her i dont think theres a future for the two of us. its ashame because i have a good credit history but dont make enough money so i cant take a mortage out on my own so im stuck renting until he has cleared that which may take up to 10 years :'(
