Natwest ccj, charging orders and our CCCS DMP

Hello everyone,
After setting up a great DMP with CCCS, we've now to the stage where every creditor except natwest has accepted the DMP. We've been paying since September and whilst they've taken the money natwest via shoosmiths are still pushing through for a CCJ. Unfortunately we have creditors to whom we owe more and if we're forced to pay Natwest more through a CCJ then I'm guessing that will seriously p!!! off the other creditors who've been very good.
Apparently Natwest are notorious for this and also for forcing through a Charging Order onto a property which then has the 8% interest added to it each year! Does anyone have any ideas of what to do? CCCS have instructed us to admit the debt and send copies of our DMP budget, but I then had an email from a "Discreet Debt Solutions" saying that they often had a better solution to offer.
I'm guessing that "discreet debt solutions" are not a charity, but haven't found any info on them? Are they dodgy in anyone's humble opinion?
CCCS have been very good, but we're really worried that if we admit the debt then Natwest will issue a "forthwith" notice - which we then will not be able to pay which will then automatically lead into the charging order being slapped onto our house.
Any advice anyone has to offer will be greatly received. After sorting everything out we seem to be heading back into the debt spiral, stress and sleepless nights, and it seems may still lose the house
Many thanks if you get this far, lilly

Can you explain, have you received any court papers in relation to this alleged debt?natwest via shoosmiths are still pushing through for a CCJ
There is nothing a company can do for you that you can't do for yourselfI'm guessing that "discreet debt solutions" are not a charity, but haven't found any info on them? Are they dodgy in anyone's humble opinion?
One word of advice, only allow CCCS to do what you want them to do, i.e pay your creditors, it's not advisable to involve them or any other debt management company once litigation has commenced.
Experienced members on this board will advise you what action to take which will be in YOUR interest should you be faced with litigation.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
I can't help so sorry but I am going through exactly the same thing with Nat West, they will not negotiate, are trying to get a "forthwith judgment", I am not working due to ill health and am living off benefits. How much do you owe them? I owe £6,700. I wish I could offer you some advice, but I can't. All the best0

Hello again.
Many thanks for replying. I owe NW £5000 roughly and my partner £8000 in the form of a joint account, separate accs, and a bank loan that was "unsecured". Natwest passed the debt over to Triton who demanded more money than our DMP suggested. We explained to triton that we could not pay the much larger sum they were demanding.
The debt then was passed to Shoosmiths who have sent us two blue court letters N9A forms of admission, two defence forms N9B, should we wish to dispute the claims, and two Response packs N9CPC.
We called CCCS and their legal dept suggested we returned the two admission forms to Shoosmiths together with our budget and the list of creditors to whom we owe money - most of which are larger than Natwests' debt - and to fill in the request to pay by installments on the N9A.
Does this make any sense? Thanks for responding, lilly0 -

I have not got to this stage yet with them, tho I expect it won't be long! I am now getting help from my local law centre and am finding this easier than CCCS as I can speak face to face. It fills me with outrage that NW can act in this way. I have found them hellish to deal with, if I had my way they would be forced to have info about charging orders on the loan agreement in great big letters. I for one would never have borrowed the money. Sorry this is no practical use to you but I do emapathise with you both0

Hello again,
To 10past6 - no we haven't yet, but its in the envelope next to me ready to go special delivery. We do owe them roughly that amount of money except that at the minute shoosmiths are charging both of us the full amount of the joint overdraft (£1700).
The original letter is dated on the 25th Jan though, so we're running out of time i think. To be honest I just filled it it according to the legal team at CCCS.do you think we should offr a defence against the claim?
Cheers, Lilly
ps yellowduck - I was a member of natwest since being ten years old and have lost count of the disputes I've had with them re overdrafts being increased unsolicited etc. Boo. Am now with Barclays......0 -
Did you receive a default notice and termination letter, PRIOR to the litigation claim? To 10past6 - no we haven't yet, but its in the envelope next to me ready to go special delivery. We've had default notices, but the last main letter arrived from shoosmiths asking for the repayment in full, and if we could not pay that, then the letters from the court would arrive...... Thanks for replying, lilly0
