Get car back or pass on finance?
Hi guys,
Not sure if this is the right place but here goes.
Last year my sister took out finance on a car for her then partner, the log book (ownership of the car) was transferred to his name and they would both pay the monthly repayments.
Since then they have both split up yet are still on talking terms, he no longer pays his half of the finance repayments but still has the car.
What options does my sister have? She continues to pay the finance yet cannot take the car back as its in his name. It would be nice if there was something we could take to him to force the car ownership back or to offer the transfer of the finance to him. Any ideas how she can keep this civil even though he does no longer wish to help pay the finance?

The logbook may be in his name but that only means he is the registered keeper - nothing else.
What was the type of finance agreement loan or hp?
What details does the original invoice show - your sisters name as "sold to or delivered to?"
There is action she can take to protect her interests but it depends on your answers to the above
The transfer of finance is a non starter as that is most likely the reason why it was put in her name originally - his bad credit record?0 -
Thanks for the reply, I have passed on your questions to her and will let you know the answers when she has checked. But I do know you are correct about him having bad credit so it makes sense that the transfer of credit is not an option.0

Ok, it is a finance loan and the car was "sold to"0

If you are sure the finance is a loan agreement and that the invoice shows the car was "sold to -your sisters name only"
Then she is the owner of the vehicle and is entitled to possession of the vehicle.
To protect her interests she should get the car back in her possession and transfer the V5 into her name - if he will not part with the V5 she will have to apply for a new one.
If you/her have difficulty with this a repossession agent will do the deed for about £200.0 -
