Gym chasing me for money

Before i had my LBM i had cancelled my gym membership but still had 4 months before i could leave.
They are now chasing me for £140 that i should have paid them.
I've just found the paperwork for this and it was just a membership agreement that i would pay them £35 a month until 1st feb 2010.
Do you know if i could just include this in my DMP as its not really "credit". I'm guessing the worst they could do would be small claims court as i have signed the membership agreement.
Any ideas?

If it's contract arrears (IE money you owe them but haven't paid) then yes, it'll count as a debt for the purposes of a DMP etc.
Although it's not a standard credit agreement as a credit card etc would be.. it's a consumer contract which if you don't pay up, will become an enforceable debt. The only way they could enforce it would be to go to court, but you should include it in your DMP.Total 'Failed Business' Debt £29,043
