But they changed my job as they were too many hours over in my original job , but placed me in an area where they knew it was'nt good for my back , so if they had'nt done that , i would have been ok

I guess their side of things would be that they tried to keep you in employment and offered you the till job as a side to the office (or was it full time?) either way if they had not offered you the job they would have made you redundant.

I am only guessing but I think that by trying to help you out they may have made things worse unintentionally

Also by your own admission there isn't a job on the shop floor you could have done as you can't walk, sit etc for long periods of time

as for occupational health why should have the company paid for it when you were showing no signs of being of for long period of times?
They were needed because of my back condition ,
In fact HR said they would get OH involved , I did ask many times , how long it would be till i would see a OH person .this was from march 2008
Its only now that they have sorted one out .

From what you describe it sounds like the job you are in really isn't suitable for someone with your condition, what can they do if they can't find something suitable they can't just make up a job that involves little standing, sitting , or walking. If you don't feel able to adapt to anything they offer then there doesn't seem much alternative to you leaving one way or another... what is it you want them to do?

I think you could use this as a bartering tool but did you put any requests in writing and did you keep records of this?

well I would talk to ACAS about this then and just make sure you know where you stand, if they have failed to act to requests and they even suggested it then it doesn't look good on them. If however you didn't show signs of the problem (ie not going on the sick for a while after the diagnosis) that may soften them not doing what they said they would untill prolonged abscense.

As I say talk to ACAS as they can give you the proper information on this

If you cant sit, stand or walk for long periods of time and the OH report backs this up you will be dismissed on capability grounds.

In all honesty if you cant even work on a check-out you are of little use to a supermarket.

Well if you prefer "don't worry about it. They will pay you indefinitly despite the fact you can't work and are not ever likely too be able too for them again"

Of course this would be completely incorrect but hey at least you will feel better. Well until you are shocked when it happens.
