    I think you might need to seek some help re the possession order - maybe start a new thread on here with the details?
    Also maybe phone Shelter or National Debtline so you can find out where you stand with it all and how to defend againt it.

  • Are you sure you'd be entitled to working tax credits once you qualify? I've been in a similar situation and quite often once you qualify you loose other entitlements as you income is too high such as housing benefit, council tax etc. So once you qualify you may possibly have a lower income initially.

    Sorry don't want to put a downer of things just pointing out some things.

    Rent and council tax are a MUST each month. Then food, then anything else.

  • Sounds like the HA already had a SPO and the terms haven't been kept to because there really was a need for a brand new cooker. They'll be pushing for enforcement of the Order, I doubt they'll get it. I used to deal with some of these hearings, the RSL never got possession. I never saw so many designer clothes as at those hearings!

    OP, I'm not sure why you posted your SOA, as far as you are concerned there are no areas (sorry other than groceries) in which any savings can be made or any areas that you are prepared to consider yet you already have an SPO and you are facing further court proceedings with the additional costs that these bring.

    I feel a bit like Catherine Tate - "whatever!"....

    I have not got a SPO as far as I am aware? I got a notice of seeking posession order last March and since then have paid £100 every month accept the one payment stated.
    I am willing to change my some details on my SOA just not the cars. I am looking into the ATHENS this morning aswell as trying to arrange some kind of budget for my money as I do not receive it all in one go each month.
    Oh just for the record I dont own any designer clothing!

    Yes, it is just over 2 miles.
    Like I said I am tied into the insurances until May anyway so to cancel one of them would just add to the debt in the 1st instance and by May I will not have the rent arrears so I will have £110 excess income to pay the other debts off.
    Apart from that if we were to get rid of our 7 seater it would then mean we cannot go anywhere as a family etc and would have to go just one of us to pick the other 2 non-resident children up meaning 1 of us would have to stay at home to care for the other 4- this is not going to work as I work shifts on placement like I said.
    If I sell the small car it means Im driving around in a 7 seater to and from placements etc which is not going to be economical anyway.

    I dont see our situation as that severe I need to loose one of the cars. I will be ok once I have paid the rent arrears.

    The other non live debts are not pursuing me at the minute- they are several years old and I do not have any other credit since then. I am not living in a credit trap etc simply have a few OLD debts that need paying off and obviously seriously need to address the rent issue.

    I have an indepedant tribuneral taking place shortly I hope with the housing benefit, I have called today & their submission has been recieved so just awaiting the letter with a date now.

    I can pay enough of the rent this month to ensure my landlords are relatively happy & I have a good relationship with them. I have keep in contact with them throughout the whole process and called them when I was unable to make 1 payment. I have not just buried me head in the sand.

    The landlady said this morning she didnt want to go for posession & would do a home visit before the court date to see how Im getting on with the arrears and tribuneral etc etc and we will go from there.

    I have a feeling it is just procedure as I had the intention of seeking posession notice in March 09 so this will run out March 10. I guess they need to cover their own butts.

    I really dont see a judge kicking me out for missing one payment out of a whole year.

    The rent arrears is £1697 I was informed this morning. A HB payment was received on the 2nd Feb which covered the period to the 31st jan. I am paying £180 tommorrow and £500 on the 19th which will bring £500 off those arrears leaving a balance of £1197.

    I dont mean to sound unbothered by it in my posts I do care but I am a very positive and strong person. We will sort it out like we always do. We have had to.

    From what I read you missed the £100.00 arrears payment, not your rent payment.

    When you have 4 children, and a winter as cold as we have had a cooker is definatly essential. You cannot feed kids salad, or waste money on takeaways.
  • I have to agree with this comment. It comes across as though you are the one considering all the options, you are the one making all the adjustments, you are the one facing up to the situation and dealing with it. Now that may be completely wrong, but that's the message we're hearing.

    Nothing against your OH, just that it really needs both of you pulling in the same direction to move forward with this, and he's probably got more time to make the kind of small adjustments that might make a big difference.

    This is what I meant. It simply sounded as though you were the ONLY one handling this and the ONLY one making any concessions or compromises.

    As I'm sure you're know, you and your OH are in this !!!!!! together so you need a JOINT plan and JOINT action. That's all I meant .... and I appreciate that you may have a joint action - I simply wasn't sure, based on your posts.

    You and OH must be in complete and full agreement about any plan of action. If either one of you isn't, then you (both) be building resentment which is all too often a one way street OUT of a relationship :(
