I need help!

I am in a DMP paying £230 per month and have been for over a year. A couple of weeks ago one of my creditors served a County Court judgement on me and I have just received the outcome today. They are asking for me to pay £357 per month starting on 3rd March or else! All my disposable income is going towards my DMP where I have a total of £40k outstanding.
I have just emailed my DMP company but they are not in until Monday and need some advise, help, anything as now feeling very sick!

    I have only just got the letter today so not been able to speak to anyone. I identified all my savings on my annual review last October and am at the bare minimum, even if I could find more I couldn't find £357 per month - its just not there to give

    I don't know anything about CCJs, but just wanted to say you have my support any sympathy. Like you say, they can't have what isn't there, so don't panic.

    Hopefully someone who knows more will be along soon with some advice.

    Have you spoken to your DMP company about this? I thought they were meant to stop the creditors from taking legal action by agreeing payment amounts on your behalf?? I would have thought they should be your first port of call.

    I have emailed them but they are not available until Monday! Just panicing at the moment and feeling extremely sick!

    Well, until they get back to you there is nothing you can do....I know that doesn't seem like much help but I have been in horrible situations with creditors in the past and can only advise you to try and just stay calm until Monday...(easier said than done I know). Please remember that things will improve and that even though we may not be able to give you the best practical advice right now, everyone on the forum is very supportive. :grouphug:

    DMP is an informal agreement. The creditors can go for a CCJ.

    It is worth noting if they were in the DMP already, then a judge doesnt look to kindly on a rush for a CCJ as you are already giving out all your disposable income fairly to all creditors. You must bring up in your defence your in a DMP and all incomes goes towards that, and you must attend the hearing. If the hearing is to far away or at a bad time, ask the court to rearrange it.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
