New to forums - need help with ex's debts that he wont deal with
eventually
Hello, I am new to posting here so apologies if it is in the wrong place - please let me know if it is.
My brief history... My ex moved into my home a few years ago and while living together he set up as self employed (sole trader). For many reasons his business didnt work out and we also split up ( Definitely NOT related). I got him to move out of my home last AUgust. I knew that at that point he had debts, both business and personal - PLUS he owed me money.
I have asked him repeatedly to change his address, but here we are nearly 6 months later and I still receive his business and personal mail. Until Xmas I passed it onto him, but prior to this point I gave him 2 weeks in which to amend his address otherwise the post would get returned to sender. He Still didnt do it.
I have been returning his post with a letter from me stating when he moved out but still I am receiving letters from his creditors.
I dont know what to do to resolve this. I have started opening the letters which dont have a return address on them so I can still return them and one arrived today that is stating that he is about to be served with a CCJ.
For personal reasons I am trying to have no contact with him, but I dont know what I can do and am concerned that some how his debts at my property will reflect on my credit rating etc.
Regarding the money he owes me personally - I took out a loan for him to buy a van loan as he had a poor credit history ( I know, hindsight is a great thing and I am way to soft for my own good). I set up a standing order for him to repay me each month. But he missed his payment last month and when I contacted him about it he just said I had to wait until the 28th Jan - almost 4 weeks after it was due. Well the 28th came and went and no sign of it. When I contacted him about it again I get told I have to wait. I have told him that is not acceptable but he has not done anything about it. I believe this will now happen each month.:(
Does anyone have any genius suggestions on how to tackle this - the address issue and the non payment of the money he owes me. COuld I take it further with a small claims and get him to repay the outstanding money for the loan? I have nothing in writing for our agreement that he would repay it, but I do have bank statements showing that he has been paying me regularly. It has been suggested to me about getting a solicitor to write to him?
Any words of advice would be greatly appreciated.
Thanks

Was the loan for the van a personal loan, or HP? I'm just thinking if the money is secured on the van could you contact the lender to explain circumstances and arrange some sort of voluntary repossession? Not perfect, and may affect you in the long run, but it would certainly save you having to pay the money each month.I'll have to sort this out!:rotfl:0

Did you transfer them money to him or was the van bought in your name?
It might be difficult to prove that the money is owed, but i would definately pursue him through the courts.
As advised, you have the option to inform the companies of his new address. He's not doing you any favours so why should you do him any?
Not sure about this, but you might be able to get a free half hour with a solicitor. Hopefully others will be able to advise on this. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Thanks for the replies so far.
Mozette - thanks for the suggestion about giving him 2 weeks to change his address. I have already requested this verbally many times and then in writing at the end of November and gave a fixed date in which to do it in. Of course he says he has paid everyone and changed his address with all his contacts, but the fact I am still getting the demanding letters suggests he hasnt done a thing!
Dads Down - The loan was a personal loan - I have recently been made redundant so have used part of my redundancy package to repay it as I didnt want to have this hanging over me while I look for work. However it now leaves me with a lot less to keep me afloat
George UK - unfortunately I just withdrew the cash and gave it to him. So it shows as a debit on my account - I know where he bought the van from (I was with him) and that he has the receipt in his business records, but the only other record that may show some agreement exists is the monthly credit into my account from him. I have already asked him to repay me in full as I dont want any further personal contact with him and feel this is just one way of him ensuring we do have contact, but he says he cannot get a loan. However as has such difficulty being honest its hard to know if he has even tried.
I do think I will end up having to walk away from this and just learn from the experience.0
