repossesion timescale and what to take!!

hi not sure if this is the right place to ask this or not but does anyone know how long repossesion takes our lender has just applied to the court and they are saying it could be 2 months or 8 months is this true, we dont know when to start packing up,

also does anyone know what you can take out the house we were going to take everything carpets, laminate, our nice light fittings our decking etc has anyone any experiance in this

    Yes, that timescale could be correct - it could even take longer but if it it going to court then at least you know the ball is rolling. Be sure to attend court and if you need extra time plead with them. Once you do go to court you will be given a definite date - I think it may be 30 days (not too sure) but that is why it is important to go if you possibly can.

    I would definitely take the light fixtures and I suppose you could take the carpet but unlikely they will fit in anywhere you move.

  • I know someone who took everything and i mean everything left a shell. They took there bathroom and kitchen as well as lighting and carpets. I took carpets and everything but i did leave the bathroom and kitchen :D
    My carpets did fit the new house so i was very lucky ......

  • hi im in court tomw for repo.to get to this stage has taken 4 mths.am going to try and get a bit more time but will see.as for taking stuff im taking everything that we have put in .im selling cooker /fridge etc.carpets going with us as house we are in is bigger than what we will get so will fit.

    Ive never heard of any mort co coming round to make any lists, lets face it,it all belongs to you until they gain possession. Take whatever you can use, obviously not leaving anything in a dangerous condition.

    It is impossible to say how long you can remain in the house. Certainly if the district judge does not hear that you can make the normal payment plus something off the arrears then possession will be granted usually 28 days to eave the property but if you are still there at that date then NOTHING will happen. The lender then has to apply fo an eviction warrant and lenders take any where from a couple of weeks to many many months (7 months in my case, 4 monts average based on client info) to do this.

    On the eviction date, unless successfully stayed, you MUST leave.

    I pressume you have no chance / dont want to keep the house ?

    Is mortgage rescue scheme appropriate or are you trying to get council or private rent ?

  • we are trying to get a council house as we just cant afford to stay i am self employed and struggled for work last year so our arrears are 5k they want it back in 1 year there is just no chance, the council have said a rescue scheme wont help us and we will lose it, we have accepted that but dont want to leave anything for someone else to benefit the mortgage company have not tried to help they have been awful.

    Its up to the DJ how long the arrears get paid back over and that can be upto the remaining mortgage term but you would need to be able to afford at least the full normal payment.

    Why not mortgage rescue ?

  • they said when they worked out the payments we did not have enough average income for it to work so they put us on a higher priority council band, but its all the waiting and not knowing where you going to end up thats the worst especially with 2 little kids, thanks for your help you have been great
