When it comes to overtime I really think it shouldnt be taken into account at all.
If a company suddenly has less work for whatever reason and they are not offering overtime then what for the op who still has to pay only now he's paying what he isnt earning. It may not always be a persons decision not to do overtime. So for this reason I think you should only be assessed on money you are guaranteed every month.
I realise theres pros and cons with this argument but I think if we just took overtime out of it it would save a lot of work and messing about for very little gain:)0 -
I agree with you Blonde Bint & I've argued this point with the CSA so many times in the early years of my case, but they just don't want to know, or probably are not allowed to defer from the legal formula that is normally applied.
I know in my case & probably many other NRPs, that after the initial split with my ex, I had to work massive amounts of overtime to cover the mortgage payments & housing costs of the PWC & my children, plus paying rent & all the other costs of setting up in a new place on my own, plus paying all the loans & debts from the marriage.
Then of course, in steps the CSA with a massive & unaffordable child support assessment based on mega amounts of overtime & therefore, the debt spiral continues.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

OP sorry if i'm stating the obvious but have you spoken to her and told her your option if she goes ahead with this is to quit work ? (sorry if anyone else has said this havent read all replies) my ex and I have just come to a private arrangement whereby he gives a little bit less than maybe he should but as he was on a low wage his alternative was to quit work if we went ahead with CSA agreement to be honest as much as i dislike him and think the way he has behaved before is appauling I still think he has a right to a life too and if faced with that as an alternative (I was) I would rather he paid an amount he could live with than something which meant he left his job and the boys got £5 p.w just wondering if its worth putting this to her of course only you are likely to know her reaction.............
