Hire Purchase Hell - Help Urgently Needed.
I took out an HP agreement on a vehicle in March 2007 the original balance was £15000.00.
I paid the loan for two years and never missed a payment (total: £9360) - I then ran into a few problems and contacted the lender and was offered a reduced payment plan and kept to this religiously for 6 months (total: £900.00). At the end of this period in September 2009 the loan company (Marsh Finance) announced that my contractual payment of £370.00 would no longer be enough and that I must pay £500 per month.
There was no possible way I could afford that and spent some time attempting to negotiate, in November I went to see the CAB. My CAB representative contacted Marsh Finance and offered the contractual payment plus £20.00 per month toward the arrears accrued during the payment plan.
From that point on until yesterday I have been contacting the solicitors to whom they had passed my account on an almost weekly basis to find out if there was any news.
I moved house during this time and gave them my new details for any information that they needed to send - on every occasion I was told there was no news and no response yet from their client and that yes they had my new address details and that no action would be taken until that time.
I kept notes - times & dates of calls every time I called.
I called again yesterday to be told that on January 7th a letter was sent (to my old address?) saying that Marsh Finance would accept the offer of £390 as long as they could also place a charge of 15k against my property. As I hadn't replied they had gone ahead and started court proceedings. During my conversation yesterday I was told that there is no record that I had ever called them and the people that I have spoken to deny outright telling me what they have told me.
I am so distressed by this and am worried that they will take the car, can someone help or advise me what to to and what they can do as my attempts to solve this seem to be met by a sheer determination to make this situation as bad as possible.

you need to start using the letter method only if this is the case, write to them or even get the cab to write to them0
