Publications use of company leaflet... should we get money for this?

My girlfriend owns her own small company and has been asked to have her leaflet included in an Exam boards Publication. Does anyone know if people usually get paid for this type of publication as it has her company log etc on it? There has been no mention so far but I don't know whether it is worth trying our luck?

  • Hello. I do know the answer as I source permissions and clear copyright, etc. for my day job. You have to tell them what your fee would be (they won't offer) educational publishers, especially exam boards, are notorious for wanting things for free! Yet they are the first to charge should anyone want to use any of their stuff!!

    Your fee will depend on how much of the leaflet they want to use, is it a three fold leaflet or an A4/A5 flyer? £50-£70 for a "one off" usage would be a fair request - ensure that you make it clear you are not allowing them to use the leaflet in any other publication other than the one they are requesting it for. Check if the rights of the publication are UK use or World use, you may be able to up your fee to £80-£90 if the rights are World usage. Also point out that they are responsible for clearing any copyright/permissions that may be necessary if the leaflet includes images/text/logos from a third pary, i.e. anything on the leaflet that you do not own copyright for.

    You want to make sure that they are not using your leaflet for anything that could harm your business. Ask to see the leaflet "in page" before you give your permission. This will involve them either sending a pdf or a proofed copy to you, so you can check how they are using your leaflet. If, for example, they are using it as an example of a badly done leaflet you will want to refuse permission. If they are using it as an example of a wonderful leaflet them no problems!! And tell them that you require one copy of the published item as part of the agreement.
