dont know if im posting in the right place help with debt plz

hi new here for posting although have read lots of interesting things on mckenzie hall the people i need help with. we owe quick quid and the debt has been passed to these monsters the debt was 449.00 and is now 429.00 as i pay 10.00 per week to them, they wont accept any payment plan and say these payments are token payments this really is all we can afford as from living with quick quid for over a year paying them off then having to loan again to have money we had to break the chain so we lost our bank card not ideall but was a nice soloutin till the debt collector letters came. the thing is they ring constantly the home phone my partners work and text my mobile the debt is in his name, they are still saying they are taking us to court ( will they even though i am making regular payments they really scare me and i feel i am being harrased so much any help and advice would be great :)

    As to court action, yes they can. They can try for as little as 1p as there is no minimum. A court will only grant a CCJ for what you can afford to pay per month, which might be less than £10 anyway so it is not always in the DCAs favour to do it.
    Give national debtline a call, they might be able to suggust some letters to send to them to see if they will accept the £10 and stop harassing you, and stop the interest if they haven't already.

    Write to them asking for all further communication to be in writing only and don't answer the phone. Do you have caller ID on your home phone, or is there a way of diverting numbers so you know which calls are work related and which are McKenzie Hall?

    I'm not an expert on DCA's but I think they may be scaring you with threats of court. You've been making weekly payments of £10 per week; that's at least £40 per month. I'd say that's more than a token payment, and if it's more than you can afford, you can pay them what you can afford only. As long as you can proove you have been making regular payments, it's highly unlikely the court would side against you.

    I know there are other folks on the forum that know more about this than I do and hopefully they can give you better advice.

  • thankyou for the replies means alot well 10.00 is alot to us as we have so many debts building up just lately but i just want to get them off our backs and i was thinking if they take us court it may go in our favor fingers crossed :)
