Getting a NO to my offers from my Creditors

The couple of times I have posted on this forum I have had some great advice, so, I'm hoping to keep that up!! Thank God for this site.......

Okay, I have 5 Creditors,

02
Halifax
Amex
Lloyds
Royal Bank of Scotland.

I have reached an agreement with Amex, thats a small amount of debt and they are happy to receive my offer.
02, I am waiting for an answer ( & have done a small claims against Carphone Warehouse because it's there error which has cause the problem. Which they have admitted once by sending a cheque for bank charges)

Halifax, RBS & Lloyds have refused my offers. I used templates from The Sterling Trust, outlined my financial situation and sent creditor lists, statement of affairs etc etc. I outlined my situation to the last pound yet they still send letters saying I need to reach the min repayment or face court action. I also asked for the interest to be frozen until I start work again at least. That part they just ignore. I use every penny of help I get from the DWP on my mortgage and bills. Luckily for me my mother helps with my shortfall or I couldn't live. I eat once a day to limit cost & buy nothing that isn't needed. I can't if I wanted to pay any more to my creditors. I have been ill for over a year now, but am to start work again in a few weeks. Had a job offer. I would just like to know, what should I say to them now? Do i let them take me to court, risk debt collectors at my door? I owe the money, I don't want an easy way out, I just need my creditors to take a proper look at my situation.

Sorry if I come across as a little muddled. I have recently ben told I'm going to be a Dad for the first time at 32 and need now to take control so I can get off to a good start when the baby arrives! It's just added a little extra urgency.

Many thanks if you have taken time to read through my text, and if you can offer some advice, you'd be helping me out, a lot!!

Ritchie

You could try again with the national debtline template, creditor refused offer. Its in the combo box. http://www.nationaldebtline.co.uk/england_wales/debt_advice.php#6

Otherwise i suggest you contact National Debtline, CCCS or PayPlan and setup a DMP with them, as they would act on your behalf to pay the creditors what you can afford regardless if they accept.
Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies

You've made an offer and should make payments to them - even if it is only £1 token payments. This would look better for you if it went to court.

If it did go to court then a judge would look at your income and expenditure and decide on a fair amount to allocate to each creditor - which may only be £1.

As you don't currently have enough money to live on, are you claiming all the benefits you're entitled to?

How much is your total debt?
Would you be able to get a Debt Relief Order (DRO)?
After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    Dad Gift 6k ¦ Savings & Inv Tst: £2,500
    Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0

    Total Owed: £2,270 (+6k) 11/08/2011

Thanks for that advice. I will do that today!
  • Thanks GeorgeUK,

I am not sure if I have been getting everything I am entitled to. I am grateful that I have had the benefit that I've had. I guess I should ring the DWP, and live with feeling like I'm taking the P*ss.

My total debt is just under £10k. They have piled the late payment fees on and interest making it that much more! My fear is obviously rubbishing my credit rating, which I guess has already happened, and if it goes to court, am I liable for court costs? Can my house come into it?

I have £30k equity in my house, but am unable to re-mortgage as my status as unemployed, other wise I'd pay it all off!
