Advise needed re partners job.

Hello,
I wonder if anyone has any advise regarding my partner, he has been working as a machanic for 5 years with the same employer. Before xmas my partner was put down to 3 days a week from 5 due to not having enough work in but he was told it would go back to 5 days after xmas. After xmas he went back to work to find no one was at his garage (due to weather) a week later he called his boss to ask when he wants him back in work, his boss said not this week and hung up. My partner then went into the garage to take some of his tools away to which his boss never said anything, after another week my partner went back to see his boss to see when he wanted him back in and his boss said he wanted him this week but he would still be on 3 days a week. He has been in work since for about 3 weeks but his boss has been asking him where some of his tools are to which my partner added that he had borrowed them to a friend (my partner had bought all his tools himself) today my partner went into work i was told by his boss that unless he brought his tools back that there would be no work for him, my partner then asked what was going on regarding his working hours ut his boss said nothing. My partner has also found out that his boss has been looking for someone else to work for him and that he has also said that my partner is also incompertant. (excuse my spelling) I really just need advise as to what to do next and wiether or not to take it further? or to just get my partner to get his tools and go back to work surely he has a case as to his boss being unfair?

Has your partner got receipts for the tools etc? If so, can't he just say, "well, they're mine, I bought them with my own money so I can do whatever I want with them"?0

You could put to the boss in writing why he claims there is not enough work to employ 5 days a week yet employ someone else. There are rules about this for redundancy, the employer must prove that the job is redundant (i.e no need for it any more) as far as i know. Although he hasn't been made redundant so I don't know what can be done. Does your husband have a contract with his employer. If so and he is contracted 5 days a week as long as he turns up 5 days a week for the appropriate hours and does all work requested of him (even just tidying I suppose? as he wouldn't tidy the garage in his own time but as part of work) then by law he should be paid according to his contract. I'm no lawyer or solicitor so look into before acting on what I say but some possibly helpful points for you.0

If your OH is incompetant then the boss needs to go through the correct channels, if not you could probably take them to an ETAlways ask ACAS0
