County Court Judgement

Hi

I recieved a letter from a solicitors that had been forwarded from a previous address stating that I owed £521.67 to a company in America Arrow Global LLC.This is the first I have heard of this company and have certainly not had any dealings with them. The solicitors were Bryan Carter & Co in Weybridge.

I wrote to them with a template letter the "prove it" letter, and also notifying them of change of address, this was done by recorded delivery.


This morning I recieved Judgement for the Claimant at my new address stating I have a judgement and have to pay £50pm stating I have not replied to the claim form.

Can any one tell me what I can do now?

  • i just looked arrow global and it gave me an address in Manchester? Apparently the buy debts...

    Arrow will probably have bought the debt from someone else. Do you have some old debts from your previous address that you have ignored/not attempted to pay back?
    Firstly you need to find out when the judgement was made. If its an old judgement/ or the claim forms were sent out before you had provided your new address/disputed the addres then you may struggle to get the judgement set aside, if not then you may be able to. Which will then mean you get the chance to defend the claim.

    You can find out about the judgement either by getting a copy of your credit file, by contacting the relevant court (if that info is in the letter sent to you) or by searching your own name at the registery trust online (cost £8 per address).

    I recieved the judgement by post today dated 31 Jan 2010 which seems strange as its a Sunday????

    They had been chasing from a previous address I just happen to get past on a letter from the solicitors (this was the first notification I had recieved at all for this alleged debt), I wrote back to them with the "prove it" letter to find out who claim that I owe money, I also told them my new address this was monday last week. Then I recieve this judgement today at my new address.

    Surely if I am questioning the ownership of a debt and not acknoledgeing it asking them to proivide proof are they not going against OFT guidelines by continuing with court action?

    National debtline can give you guidence on this.

    In your defence you can argue, you gave the creditor your new address but neither the courts or creditor forwarded on the proposed court action, as such you had no chance to attend the hearing.
    Further more during this time where you had no heard from the creditor, you had asked for proof of the debt, but the creditor failed to reply to this letter as well.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
