Hello
I've been on a debt management plan for the last 3 and half years...suddenly it appears tht CAPONE have passed my account to the above......iv'e yet to receive any offical notification from CAPONE ...and have told Fredrickson that until I do I won't send them my inc/exp account.
I've had a couple of calls from them ...ive told them to deal with me in writing...during one call...the guy said tht CAPONE still owned the debt...the second convo..the girl said they had the debt...does anyone hav any dealings with these peeps?
They also told me tht I shud contact CAPONE re ther taking over the account....but ive told them that as its ther client its up to them to contact CAPONE and get them to send something.
TIA

Usually when a DCA contacts you for the first time you are advised to send the prove it letter, which basically means they have to provide proof they can collect the debt/ or a notice of assignment. If you've only spoken to them on the phone it might be worth putting it in writing. - http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

Thank I have written to them explaining my position...but they rang again today...I reiterated what I had said before..explaining that I wasn't trying to b awkward...just that I don't believe procedure has been followed.
I had recently asked CAPONE for the CCA(?) ..they sent me a copy of there terms and conditions...so i do wonder if this debt is enforceable....which ever way i dont mind carrying on paying my current payment..its all that I can do currently0 -
When you do a CCA there are certain things to check for, this topic details it all for you - http://forums.moneysavingexpert.com/showthread.html?p=26867731#post26867731Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0
