Overseas debt chased through UK solicitor?

    They are required to provide you proof of the debt, and that the debt is recoverable under UK law.

    As the above say, this debt is from outside the UK, the EU even, as such they won't have any legal powers to recover any debt. Any payments you make will be volentary.

    As to beign statute barred, it is upto them to prove it is not. Saying i don't think it is statute barred is insufficent.

    If they were to attempt court action they would need to do it under UK law, bring proof of the debt and proof the debt is not statute barred.
    The best they can do is a CCJ in Australia and wait for your return.

    Give national debtline a call, i am sure they will agree that they cant do anything.

  • Hi Im looking for advice regarding a debt with a bank in Holland due to a house sale going wrong and the buyer suing me, i have had no contact with the bank since leaving Holland back in 2002 and have no had a posted notice of a statutory demand form a UK collection company threatening Bankruptcy, do they have any legal rights to claim this debt?
