Seperated and in negative equity

Hi,

Me and my wife have a shared ownership flat thats in negative equity. I understand that if we made profit then i would have to buy her out, but if we are in negative equity, is she entitled to pay me half of the deficit in order to 'buy herself' out of the mortgage. I can afford to remain here and wish to stay

We are married etc and she has left me.

Any advice is apprecitaed

  • Do you have the income to support the mortgage on your own?

    If not, the lender won't let her off the mortgage. You will have to bide your time.

    If yes, then maybe in principle she might owe you something, but that would probably have to be considered in light of the overall financial settlement, including for example the potential of her having a chunk of your pension rights, when divorce is discussed.
