Statement of Affairs (Debtor's Petition)

I am just getting my head around the BR form and I am filling in the part for Unsecured creditors -I am using details sent to me on my IVA failure certificate.

Is this for debts which arent morgages etc?

I have had a debt sold off to Max Recovery and for the life of me I cant remember teh date and the details of the debst which have been sold off to this company. I got into an IVA in 2006 and subsequently this debt was sold onto these guys - what do i put on the form as it wants the date incurred and creditor type? Plus it says what was the debt for?

Anyone offer advice on filling in this form?

  • You are right in that unsecured means non mortgaged debts, you will need to put uncle Max's details in, you need to take a stab at when the debt started ,you'll have to guess what it's for. 'General living expenses' is a catch all if nowt else fits. Creditor type is bank, loan, over,draft, creit ,card personal, anything really. The O.R. is not a monster they will treat you with sympathy.
    Take your time with the form do a bit at the time. Initial any changes , the O.R. will just chat over the phone nothing to worry about as long as you got it all written down in front of you. good luck
  • I couldn't remember any of my details so got hold of a copy of my credit report using the free trial from credit expert to get hold of the majority of details for the form.
  • Thanks for info - trouble is I dont have a credit card so I cant look at credit file as they want a credit card up front..

    i think you can write to them to obtain credit report - find out how much it is, i think £2 but check, and get a postal order...hope this helps

    If you can't easily get details, then just put your best guess.

    Once printed add a note in the extra info section, or by the entry itself saying you are not sure. Initial any changes in the printed forms.

    It's not critical for the petition that every exact detail is there.

    If needed, the OR can make their own enquiries with Max Recovery or you former IP.

    In other words, don't be too concerned. about it. :)
