CCA QUERY-Freemans Catalouge

I have an outstanding debt with Freemans catalouge. The debt has now been passed over to Moorcroft Debt Recovery Limited. I sent the template letter requesting a copy of my original agreement. As i that i did not sign the aggreement i still have the original paperwork which is dated before 2007 and i never signed them. I received a letter today from Moorcroft basically saying that they have forwarded my request to there client etc.. and my account has been placed on hold until the documentataion has been supplied. And they will not seek to enforce payment of the debt.
My Question is i am on a dmp with Payplan and my 1st payment to them is due to go out on the 26 February. Do i tell Payplan not to pay freemans until this matter is sorted? or do i ask them to pay them as normal.
Thanks

That is correct, you should cease repayments until they provide the CCA - however bear in mind it could affect your credit rating and you will get defaulted (if not already)....
Old catalogue accounts are rife with unenforceability due to the lacklustre way they were issued (in the past)...

Hi
I sent the Template letters to Moorcroft on the 23rd January 2010 and i got a reply from them dated the 29th January stating that they had forwarded my letter to Freemans requesting the CCA. I then get a letter from freemans dated the 5th Feb stating that my CCA will be sent to me. So far i havent recived any thing in the post. But i got a letter from Moorcroft stating that there client has ordered a copy of my agreement which should be with me shortly and they will recommence collection after a period of 7 days from the date of letter (11th Feb).
My question is do i write another letter stating that i havent received the CCA?
And can they commence collection even though i havent received the CCA? I have advised payplan not to make payment until i have received the CCA.
Thanks0 -
