Collection agent...can they take my stuff??

One of my credit cards which I have been unable to pay for a while has said they will be sending round a collection agent to my house. As this is an unsecured loan will they be allowed to act as baliffs and take my furniture etc? I hardly own anything as it is and we (my young son and I) certainly can't afford to replace things like a sofa or beds. Will they be able to do this? Is this what they are coming round to do or is it just to talk and try and sort out a repayment plan? As things stand I have a bankruptcy hearing in 14 days time so I don't want them to take everything before I go bankrupt although they are due to come round a few days before the hearing...any help would be really appreciated as I am really terrified that we will be left with nothing. Thank you.

    Absolutely not.

Only if you have a CCJ and don't keep up with the repayments ordered could baliffs come to your house and only they can seize property.

If they turn up then just ask them to leave. If they don't phone the police. They have no rights to stay once you have told them to leave - in fact there is a letter you can send telling them they cannot come in the first place - I'll just go find a link....

...right third letter in this post contains the legal bit about revoking their right to visit, you might need to change the opening paragraph for your circumstances

  • Thank you so much, thank you for answering so quickly too - practical and reassuring advice, going to amend and print off the letter now - can't tell you how much that helps! Thank you.
