Help regarding a debt company please!

Basically have a £800 debt and it has been passed from the company we owed money to to a debt company.
We are finally in a position to pay this debt and my husband just called the debt company to make an arrangement to pay but they refused to allow him to pay £50 a month and said it would have to go court because my husband refused to give my tax credits income and his employers name and address.
Where do we stand please??

    Hi

You don't have to give this information to them, and I would advise you not to. However it is normal practice to complete an income & expenditure statement to show that £50 per month is all you can afford.

They could in theory take you to court, although for £800 this is unlikely especially if you are offering £50 per month.

Its better not to call the DCA, but always put all offers in writing to them. So as a way forward I'd suggest he writes to them offering £50 per month and enclosing the first payment.

If they did decide to take you to court you would need to prove to the judge that £50 is all you can afford to pay (and that you are not spending excessively elsewhere), they would then likely grant a CCJ but say you have to repay it at the £50pm.

  • Thank you very much.
I cant write to them until they send us some paperwork so think we shall sit tight and wait for the first threatening letter to arrive!

Thanks for putting my mind at rest :)

    Dear Sir/Madam

    Re Account No/Reference No:- 4563210025897412

Since making that above agreement with you, our circumstances have changed.
We cannot now afford to agreed monthly payments because ... [your paragraph added here]
We enclose a Personal Budget sheet which shows our total income from all sources, and our outgoings. As
you can see we have only £_____ per month left for our creditors.

The offers we have made to our creditors have worked out on a pro-rata basis, and we have written to all our
creditors asking them to accept reduced payments.

In view of our circumstances, please would you agree to accept a reduced offer of £_____ per month. If
interest or other charges are being added to the account we would be grateful if you would freeze these so that
all payments made will reduce what I owe you.

Should our circumstances improve we will contact you again.

We would be grateful if you would send a [paying-in book] [standing order form] to make it easier to pay you.

Thank you for your assistance. We look forward to hearing from you as soon as possible.

    Yours faithfully
