Bailiffs - Collect Services -Council Tax

I had a liability order made against me for late payment of council tax on behalf of my district council for which I am paying 100.00 per month to the above firm.

The bailiff is pressuring me to allow him onto my premises to make an arrangement to pay the debt which I have refused to do on advice given to me by National Debtline and the CAB . However, the bailiff says the information given to me is wrong and this is a new law on complaining to my council they agreed with the bailiff and said I must allow him in to make the agreement.

So, the bailiff is now making veiled threats in a very calm collected way of vans comming round and more charges being incurred, the council clerks in the court section support the bailiff and I am now getting angry:mad: To top it all the last remark from our jovial debt collector was that at the end of the day I didnt pay what was owed. True, but not intentially, like many others I just hit a blip:o its quite common nowadays !

Has anyone else had dealings with this company or does anyone have any advice for me please.

    Please do not let the bailiffs into your house. next time he rings/you ring, tyell him you are recording the call and asdk him to quote exactly which pice of legislation he claims makes the NDL advice wrong.

    Because, if you ask him to do this when the evidence can be used against him, he will not try.

    If you refuse to let him in, he can charge a grand total of £42.50 for two visits. If he adds any more to the bill, it is illegal. Not that this stops some othe them trying.

    if you let him in the house, he can immediately add the levy fee/WPO fee and if there is any problem paying, he can add the van fee abotu £150.

    As long as you keep him out and do not enable a levy on a car, then £42.450 is the max fee, howeve rmany times he visits.

    The law is clear on bailiffs collecting countil tax.

    First, Do not let them in, if they want to discuss this matter in person, ask them to send you a request in writing regarding what areas they would like to talk about in person, then phone herbie21 ( http://www.bailiffadviceonline.co.uk/ ) and get her opinion. As i believe the bailiff is lying to you to gain peaceful entry in order to make more charges. Other such lies are i need to use the phone/toilet etc...

    If they are lying inform your local MP/councillor that the council is using a bailiff that has attempted to gain access to your property by deception, and request the immediate return of the debt back to the council.

    Seriously, I agree with what others have said. I've actually been in the bailiff's shoes (though I like to think I was an exception to the bit about telling lies, but I'll let others be the judge of that;)) and they will say just about anything to get into your house so they can seize goods to force you to pay the debt on their schedule and to charge you extra fees for the privilege of doing so.

    They don't need to come into your house, they have no power to force you to let them in at this stage, and they are trying to trick you. As RAS says, if they don't levy (the posh term for seizing goods) then all they can charge is a total of £42.50 for 2 visits.

    Any fees other than that when they haven't levied are illegal, and we actually like to see that because it makes it easier for us to help you slap the bailiff and the council who are responsible for their actions around a bit.

    One day a bailiff company will wise up to this and make all their staff work precisely to the law and this will actually make it more difficult to "beat" them. but until then if they wish to make it easy...

    Knowledge is power - the bailiff knows that the majority of the people they speak to are ignorant of their own rights and those of the bailiff, and this gives the bailiff power over those people, to bully and intimidate them into paying their debt.

    Now you've seen the advice from the others in this thread you have knowledge and therefore power.
