major advice needed plz

ok i posted further down about my current situation with HSBC, anyway it just dawned on me the letter states hubby is behind on 9 payments However, they never took a payment from him and infact asked him to come in and resign wel the paperwork which we declined, (therefore never ever took a payment even though CCCS was depositing amounts each month to them)
so does this mean i should not repay this debt? (at least to the new collectors) or should i ask for a copy of the original signed agreementcould there be some sort of loop hole which states that payment can not be made yatter yatter
dont understand and need some advice plz
