Reclaiming Subscription Fees from TRACKER NETWORK UK

Hi,

Any advice gratefully received.

I had a TRACKER system installed in a previous car which was an insurance wrote-off in Apr 2005. Hence, I no longer owned the vehicle after that date (formally confirmed by DVLA and the Insurance company).

However, TRACKER continued to take annual subscription from my credit card. I only noticed these payments whilst going back through my credit card statements recently (I know its very slack of me!!).

The TRACKER contract was never formally cancelled, however, I would like advice on the legality of taking fees for a service which cannot be provided..

TRACKER are telling me, that I didn't cancel so its tough luck on my part.

Any advice?

You have a contract with them and you never cancelled the contract. So, as far as they are concerned, they have been providing the service in agreement with your contract.

Which is correct. You would be relying on their goodwill as you never cancelled.
