Anyone know variation timescales?

Hi last week my OH sent back all the info requested from him to the CSA as the PWC has applied for a variation. I know that they will send this on to her, but would like to have a idea as to when this might be so I can ready myself for the torrent of abuse that is bound to come our way. She is going to be very upset that the facts don't match her assumptions and allegations and even more upset that she can't have the 'more than half of both your incomes' that she thinks she's entitled to now the government have stopped paying her.
If he phoned to find out what sequence and timeline is would they tell him?

    She will probably have her variation turned down within a few weeks.

    She will then have the right of appeal within the CSA itself - this means another case worker will look at the case and turn the variation down again.

    Don't get too excited though, turning down variations is standard CSA procedure. The Ex will then have the right to ask for a Tribunal and this is when it gets serious. Note that if the CSA does find for the variation the you also have the right to appeal and then ask for a Tribunal.

    In my experience the Tribunal will ask for evidence that the NRP is earning what he says and has no other income, in my case this was bank accounts, credit card and loan accounts and all company accounts. As long as you can back up your income and expenditure with proof and it tallies with what you've been saying all along, then a Tribunal should hold no fear for you.

    However this part is long winded and drawn out - I am waiting for a Tribunal date and it's been over a year, partly because of the reluctance of my ex to provide certain details but mostly because the Tribunal itself seems very slow.

    Any child maintenance award can go up or down and any change should be backdated to the time the award was in dispute - that could be a large amount.

  • Thanks, its reasuring to know that we can appeal ourselves if nessicary because I'm 100% sure we have nothing to hide, having said that I'm not so sure I would cope with the on going stress.

    Regarding the backdating how do I go about getting the csa account details for a SO, we cancelled the DD when they were still taking money after he had set up a SO to the pwc but then the CSA told us to cancel private agreement as she hadn't informed them, (although she claims she did, but tbh I'm more inclined to believe the csa despite their track record, thats her style). Don't want to get into an arrears situation (got more than enough debt already!!) and we have now missed January's payment. Also don't want child to go without due to adults being unable to co-operate.
