Holiday Entitlement and Bank Holidays

Hi
My OH works in retail. The concession he works for states that they can't take paid holiday in the first six months of working there, I presume that is because they need to accrue it first. However they are also required to work bank holidays so does that mean that bank holidays get added to his holiday entitlement say 28 days or are they included within the 28 days, the owner of the concession won't give him a straight answer so am a bit confused at how it all works.
He doesn't have a contract but works full time, 5 days a week.
Thanks in advance

Suggest OH joins the Union first
Rule No10 -
What does their contract say?!I was born too late, into a world that doesn't care
Oh I wish I was a punk rocker with flowers in my hair0 -
No one has the given right to time off for bank holidays.
The current statutory holiday entitlement is 5.6 weeks per annum, thats 28 days for someone on a 5 day week. These 28 days may or may not include the 8 bank holidays this is down to your employers.
What does the contract say? 28 days + bank holidays or just 28 days?0 -
Hi
Thanks for the replies.
He doesn't have a contract, he works for a small business and the owner (who doesn't believe in doing contracts) seems to just make things up on the fly.
He's previously asked the owner and was told that he didn't know what to do about bank holidays and wasn't even sure if he was doing it correctly in terms of holiday allowances so OH thought he better found out so at least one of them knew!
But given that bank holidays aren't statutory I would presume that it would be the 28 days.0 -
Regardless of how small the company is every person is entitled to a written statement of particulars about their employment. This may be any where from the initial offer letter to just one piece of paper showing everything required.
In most cases if it is a small employer they will not be able to afford contractual holiday so will just pay the statutory 5.6 weeks0
