notice periods

Hi all a friend has just been deducted 2 weeks pay as she never worked her full notice period, her month runs from the 15th-15th and she handed in her notice on the 8th and worked for a week the manager where she worked agreed and said she doesn’t have to work her full notice and she has now received her pay minus 2 weeks are they allowed to do this?

    Do you mean she was deducted pay she was due or she was deducted pay for a period she didnt work?

    Are you saying that she worked from 15th December (month only for example purposes) until 15th January but has only received 2 weeks pay for this? If she handed her notice in on 8th January and left on 15th she should have been paid for the full month 15th dec-15th jan.

  • thats what im saying but they have taken 2 weeks pay of her for not working the full months notice even though her manager agreed and said she can do a week.

    What does her contract say about termination of employment and notice periods?

    I suspect that when the Manager said she did not have to work her notice, he/she believed there was an agreement on both sides not to work and therefore not to pay. Unfortunately without written approval for paid time off, she will not be entitled to be paid.

    Hard lesson learned.

    i understand what you mean but when she left on the 15th she had compleated a full month (15th dec till the 15th jan) so she was expecting a full months pay.

    doe she work 2 weeks in hand tho instead of 4? Think we'd need to have the section of her contract in order to give best advice, can she lay her hands on it?

    She is entitled to 4 weeks salary for the 4 weeks she worked. They shouldnt be deducting anything. The notice period thing doesnt come into it. She needs to phone them. Its probably just an error on their part.

    Edit: (Unless of course they paid her for an extra 2 weeks when she first started there - dont know what dates etc she started and what they initially paid her for)

    ^^^^ unless there is a clause in her contract stating that failure to give required notice will incure a deduction of the amount of notice required, or something along those lines.
