NT Tax Code - Tax Rebate

Am in desperate need of assistance as I am getting no where fast with HMRC!
My parents live in Spain and receive an income from Personal Pension in UK.
The Pension provider is finally applying a NT tax code so that they get their pension income gross (through double taxation rules). However, no one seems to know where the tax rebate comes from for the over paid tax (when a BR tax code was applied).
The Pension Provider has clear written instructions (which I have seen) stating that 'no refund is to be made with a NT tax code'.
However, HMRC have told me and my parents several times that the rebate must come from the pension provider.
End result is we are getting no where fast. With my parents in extremely poor health already this is not helping.
Does anyone out there know how, where, when I can get this tax rebate for my parents?

For the current tax year, you need to get the tax office to tell the pension provider that the notice of coding is incorrect and that a refund can be made.
For previous tax years, HMRC will make the refund.£705,000 raised by client groups in the past 18 mths :beer:0
