What to ask the solicitor: Advice please

Hello again

I have one last question before OH's hearing next week (last one, promise!). He's going to be speaking to his solicitor on Monday - what should he be asking the solicitor and also what else should he be telling him.

He's going to mention that X sounds like she's going to cause a scene and mention money and pretty much everything that she feels OH has ever done wrong (shame for her that the hearing isn't a week long :D).

Sou suggested yesterday about getting a punitive clause added to the CO so that OH has some comeback if (WHEN!!) X starts messing him about.

If anyone has any other suggestions I'd really like to hear them! If this goes beyond the first hearing OH will have to move to representing himself so the more we can get from having the solicitor the better.

    I thought someone had replied to this - oh great now my mind's going!

    For some reason X has kicked off today - OH is going to fill me in when he gets back but basically she's been saying:

    1. That when we have DSD she should always be with her dad. She does spend some time alone with me (like today - I've picked her up from school - at X's request!!) and OH sometimes works Saturday mornings when we have her. We're trying to save for a deposit at the moment plus pay legal costs so this is fairly necessary! Can she really dictate that this can't be? Surely this would be the situtation in a 'normal' (haha!) family set up?

    X doesn't spend every minute with her children when she has them (not saying she should btw) so I'm struggling a bit to see how she can make this demand.

    2. She's sent OH messages saying he's "going to regret everything he's done to her for the past few years". I have genuinely no idea what this means. Paying his CM on time, never missing an access visit, never bad mouthing his X to his DD?? Who knows. I don't think she can separate OH as a father from OH as her X IYSWIM. She's still pretty !!!!!! off that her shenanigans haven't split us up.

    I know no-one can predict this but will a court entertain her if she starts ranting about what an a*sehole she thinks OH is? I really do hope not!

    I'm hoping they would come from the direction that if he was such an awful person then why would she have allowed X to have the access he does (works out at 5 nights per fortnight).

    Something tells me this court case isn't going to resolve much :mad:

    Anyone have any reassuring words? :)

    Sadly it was me that replied with re-assuring words, basically I said the OH should have no problems representing himself, the courts don't take any rubbish and see sense, they won't let the case run as a battle with winners and losers , the case may run on but with each attendance there should be positive progress.

    One thing to remember is that you will get a review date set, if not ask for one. If teh ex then breaks the Order you have the court date set already and a Court Officer on call.

    It helps beleive me.
