Ruthbridge Limited - Help

Hi,

I recieved a 'To the occupier' letter from these guys about 2 weeks ago. I checked them out & promptly ignored it. I now have recieved a letter addressed to me saying I have failed to respond to mail directed to me & I have been traced to my address (well that's not difficult for a start!) They also say if I don't establish contact with them inm 5 days they will send a 'local agent' round.

Can they do this?

The letter makes no mention of what I'm supposed to owe or who I'm supposed to owe it to! It is possible it may relate to a legitimate debt as I defaulted on an IVA back in 2008 & lost a lot of paperwork as I moved shortly after, however I have paid off any body who has contacted me since and I thought everything had been cleared, I've even started trying to rebuild my credit rating. To be honest I'm not inclined to speak to these people from what I've read about them. Any advice gratefully recieved.

If they send a local agent, then you can advise said body where to go - they have no right to visit other than with your full consent at an agreed time.

Have you checked your credit record to see if Ruthless feature there?

it would also allow you to identify which debts have been paid off as well.

Please do not just write to any DCA.

And because you have done and IVA things are more complicated.

Please talk to one of the debt charities before you write to anyone.

    Speak to national debtline!

    Worth noting http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf
    Communication
2.1 It is unfair to communicate, in whatever form, with consumers in an unclear,
    inaccurate or misleading manner.
2.2 Examples of unfair practices are as follows:
    b. leaving out or presenting information in such a way that it
creates a false or misleading impression or exploits debtors'
    lack of knowledge
    c. those contacting debtors not making clear who they are, who
    they work for

    Deceptive and/or unfair methods
2.7 Dealings with debtors are not to be deceitful and/or unfair.
2.8 Examples of unfair practices are as follows:
    a. sending demands for payment to an individual when it is uncertain that
they are the debtor in question, for example, threatening debt recovery
action to 'the occupier' or sending a payment demand to all people sharing
the same name/date of birth as a debtor in the hope that contact with the
    correct debtor will be made.

    Debt collection visits
2.11 Those visiting debtors must not act in an unclear or threatening manner.
2.12 Examples of unfair practices are:
    a. not making the purpose of any proposed visit clear, for example, merely
stating that collectors or field agents will call is not sufficient

If they visit, tell them to go away. if they don't call the police. A debt agent have no powers, it is bailiffs used after a CCJ that have some power.

I hope that someone out there can give me their opinion on the following.

I received a letter from RR today addressed to the occupier and requesting that the occupier please contact "Miss Julie Edwards" who is their "Customer Relations Officer" on a freephone number 0800 6888 310. They quote a reference number of course.

I was curious about them so I looked around the net and found this forum - and very helpful too. I was not surprised that RR appear to be a rather abusive, ugly outfit using unlawful bullyboy tactics to scare people.

I have no reason to be contacted by any CRA and I think that I shall just ignore it altogether. However, I also think that they may be fishing for information about someone who once lived here and ran up a lot of debt. I hasten to add this was at least 8 years ago.

I note that the tactic they have chosen to use in my case has not been discussed. (I.e. They ask the occupier to contact them but I have not even considered contacting them.)

I would welcome any constructive advice from anyone at this point. My own instinct is to ignore them. Perhaps a collective onslaught on their freephone number may be a small way to get our own back!?

If it is addressed to the Occupier, it is legally only one step up from junk mail, and therefore safe to ignore. If they get your name, you can send a letter asking them to identify themselves and what they want, while refuting knowledge of any debt owed to them.

Never sign a letter - digital, print or watermark it. These types have been known to forge agreements (not specifically RR, but some have been known).

    Good luck x

    Hi,
I wonder if anyone can help. I’m sorry if I’m duplicating but I’m new to this forum and I’m so worried about this issue.
I have today received a letter from Ruthbridge adressed to 'The Occupier' with our address slightly wrong (postcode and spelling).
This simply requests that we ring immediately and gives a reference number.
Having read some of the forums i believe this probably refers to a debt my partner holds for a car from approximately 5 years ago. He has been paying this off but admittedly in a sporadic fashion.
I have no intention of ringing Ruthbridge (after all i've read!) but we are trying very hard to straighten out our finances and I'm very worried about this and how much extra charge they are likely to add. It's making me so upset.
Could anyone help with the best way forward at this point?
    Thanks

I purchased a car on finance i believe around 2004. I lost my job and couldnt meet the payments so agreed with the finance company they could take the car back and i wouldnt have to make any more payments. Now i have started to receive letters from this company, after reading information on this site i wrote to them asking for a copy of the agreement. They have sent me a copy of a credit agreement dated 2004 and a payment schedule which im not sure they havent just made themselves as one of the payments says it was made by cheque and i have never had a cheque book. the agreement says that if a certain figure is paid off around £2500 then the car can be returned. there schedule states i have paid around £5000. i dont really know what i should do can someone please help...

Hi. I'll move that post to a new thread, as that makes it easier for people to help with your particular case.

I'll add a link to the new thread below in a sec....

for some reason it wont let me reply on the thread you have created any idea what it is i need to do?
  • I have to say it's probably not the most responsible way forward and I am very committed to clearing any debts that can still be proved but I just ignored these guys & they went away. Think the whole thing was an upsetting fishing expedition. good luck anyone who has to deal with them.
