!!!!!! just happened?

Hi folks,

Well most of you will know that I had 5 debts which got passed around some 30 or so DCA's! I'm now pursuing them all reclaim charges - a mammoth undertaking that has taken many months to plan and execute. I've just started sending out the LBA's to them all but lots of them have forwarded the letters to the OR??

Now the main one is RBoS, who I successfully got my charges back from, for the tune of some near £3k. I did that to pay off my debt with RBS but now RBS have written to me saying that they have no intention of pursuing the debt and have effectively written it off? They say it's in-house, won't be passed on and won't be pursued.

I still owe £1k because I had to pay for my cat to go to the vet but now I don't think I owe it? I'm so confused about what the hell is happening here, the only reason I got my charges back was to give it to the creditors (mainly RBoS) to pay off my debt and now the bank say that they don't want my money? Eh?

What should I do? I'm still in the middle of a mammoth data gathering operation to start opening claims against all DCA's that have charged me. Plus I've been doing CCA 1974 requests which they have forwarded back to the OR's too. Surely if it was to THEM then they have to provide the papers, as the CCA says they have to whether they are the original creditor or not.

I don't think anyone has been in this situation chasing so many companies at once for just 5 debts. Admittedly it's costing me a fortune (quite literally hundreds) in postal orders, letters, stamps and so forth. I accepted that a certain % of my reclaimed charges would be swallowed up but 75% of something is better than 100% of nothing.

I'm just really confused as to what's going on? Any ideas?

    Can you explain what OP, LBA and CCa means please?

    You say this is costing you hundreds but what are you going to do with the RBoS situation them? Pay the last £1k or not? I guess if you don't have to pay the outstanding amount to the RBoS then that the postal charges sorted!!

    Do you want to keep fighting? How much have you paid in charges to the DCAs?

    Id be interested how you did this... I have 'many' creditors who have passed debts here there and everywhere (some dont even know how now owns the debt !). How did you initially start your claim of your fees.

    Are you under a dmp or something still ?

    Ive put a tester in to Barclays, but thats 2 weeks ago and havent heard anything from them, it was just the initial i demand my fees back etc....

    Any help would be great.

    OR=Original Receiver (who I owe money two, or in this case now who owes me money!), LBA=Letter Before Action (the last letter I send before I start court proceedings), CCA=Consumer Credit Act 1974 (I have the right to request information from a DCA which by law they must supply), DCA=Debt Collection Agency.

    Hi Mike,

    I've never been on a DMP, I did all of this myself. The other posts I reference in my origninal post above contain most the information on how I went about it, it might be worth going over them for another nose.

    Basically I created an exhaustive list of all my debts, then created a timeline for each one to show who it had been passed to (starting with the OR). I've then been collecting more information for each time the debt was bought, to see how much the debt was when purchased by each DCA and how much it was when it was sold on. Combined with information on what payments I made at what time (and to who), I can see that all the money I paid has gone towards my debt. If the figure has risen unexpectedly (it should never have risen anyway), then I know I've most likely been charged so I focus on gathering information for that period for that DCA.

    It really is a mammoth task, and I had a 3 foot high stack of paperwork to work to get me started. Since then it has doubled with the amount of paperwork I've generated and replies to that paperwork. I've also got spreadsheets coming out of my ears too lol. I don't think many people appreciate the gigantity of preparing to take some 30 DCA's to court :-\

    My second stage was to construct a spreadsheet containing details of the 30 DCA's who I intended to sue (the thought being they were guilty until proven innocent!), so I asked them to supply me proof through CCA requests (and now DPA requests), that I wasn't charged. Anyone who cannot show me proof is guilty as far as I'm concerned and will be going through the next round where I start court proceedings against them. Anyone who I am satisfied has not charged me gets struck of the spreadsheet. When I've got replies from them all, I should have a definitive list of what debt, who charged me, how much, and roughtly when. This is enough for my particulars of claim at the County Court.

    Nearly all of them so far have failed to provide me any information at all, but every single one of them has failed to provide me true copies of my credit agreements and statements of account as is my right under the CCA. Basically they have all committed an offence, and of course, I shall be making complaints about them all.

    Of course I'm not totally stupid and I knew that by making the request for copies of paperwork to 30 companies at the same time it would be a logistical nightmare for them and most of them would fail to provide it to me - I was counting on this partially to slow down any counter claims I might receive. But, the strangety is, they have all failed and now nobody wants me to repay them?

    They are either not fussed by me or are very scared of me? I'm unsure of which?

    Good luck if you intend to do the same thing Mike, but it won't be easy. I'm happy to answer any questions you have or offer any more info on how I've gone about it if needed.

    Did they actually write to you saying they were charging you or is it just an assumption?

    Usually DCAs make their money by buying the debt at 40% or so and then collecting the full amount from you (60% profit). In reality this effectively means that your interest is frozen but may charge only for missed payments. They rarely charge for taking on your debt.

    I assume all of them to be guilty until they can prove to me otherwise. At the moment, the proof isn't very forthcoming which certainly arouses my suspicions somewhat.

    If they were innocent and just, why avoid my requests like the plague, and even to the point of breaking the law to do so? They have all now committed criminal offences by ignoring my requests BTW.
