Csa payments have dropped from ex - HELP

I'm new to this site, please any advice

I'm a single dad of 2 boys, aged 10 & 15 (wife ran off 4 years ago), she's been paying mantainance of £126.50 a month for the last 2 years, after a fight to get it, then it all changed in november 2009

She works for a hairdressers, She still works for the same company, doing the same job, but she moves to a different shop, still owned by the company, so nothing has changed but her location, then all of a sudden, she tells them her wages have dropped, and i only get £2.50 per week per child, £20 a month from the Csa, she is behind with the payments and owes me £440 in arrears, i know some of you get nothing, but then some of you know how it works.

My ex (yes i divorced here) is self employed, and i have full custody of both my boys.

She has no contact with the boys due to court orders, and the police.

Any help please, Thank you.

    Good luck mate, if the tables were turned and it were the usual case of nrp/pwc then there would be many encouraging responses already. It will be interesting to see if the usual mob assist :o

    Phone the CSA and ask why payments have dropped.

    If they say it is because her income has dropped, phone HMRC and advise them that you believe she is now working cash in hand.

    You'll have to do this, the CSA won't bother.

    The problem is her being self employed. S/E people are notorious for hiding money and making the books look quite different to reality and it's incredibly different to prove otherwise.

    I would second Sou's advice as the HMRC hate tax evasion and have more clout than the CSA.

    Another thing is you could apply for a variation on her lifestyle being inconsistent with her earnings. £20 per month is what a person on benefits would pay so for her to be working full time and paying that is absurd.

    But you first need to find out why they have dropped so much and what the CSA are doing about it so phone them ASAP.

    Just to repeat what I've said on another thread - if you go for lifestyle inconsistent with earnings (good spot Loopy) then you will be expected to provide all evidence and you will almost certainly be refused this by the CSA but this gives you a bite at the Tribunal cherry, which in my experience is a lot more thorough.

    Proof of lifestyle inconsistent do a statement of affairs for your ex trying to fill out all her expenses as accurately as possible (some will be guesses but some not even if you never talk to her) with proof to back up your figures - lots of things are on the internet, if you know her address then if you pay a nominal sum to the land registry, you can find out if she has a mortgage on the address. You can also find out what council tax she should be paying by using your local council website. If she rents then find out an average rent for her area, include all paperwork, quotes etc. Basically you want to give reasonable doubt as to whether she can afford this lifestyle on the salary she claims.

    It takes a bit of time and effort and as I say the CSA will almost certainly decline you for lack of evidence. Then you write back and ask for Tribunal - they will then take over the investigating.

    However, they take a long time, maintenance awards can be reduced as well as increased and the change should apply from the date you disputed payment (over a year ago for me).
