Payment Missing

I called the CSA to see what was happening with our case, we recently went through a reassessment and the NRP has to pay more. DOE has always been in place but since the new amount has gone up the DOE hasn't taken place. Apparently the payment was issued on the 22 but yet to be recieved.
The person I spoke to said that they will be monitoring our case as the payment wasn't for the full amount. She did mention going to court but what for?

What is the protected income amount?

On CS1

Comments

  • I don't why it would go to court, but on CSA1 the protected earnings amount is listed on the assessment notification that they send. Its not the same for everyone as it takes into account mortgage etc.
  • If a DEO is in place, the company has up to the 19th of the following month to pay the money to the CSA. My ex was paid on 20 July last year and his first DEO payment was sent from his employer to the CSA on 19th August. The CSA then paid it into my account around seven days later.

When I queried why the employer hung onto the payment for so long, I was told that the CSA have to allow employers up to the 19th of the following month to turn the payment over to the CSA, regardless of the actual pay date.

There have been times when the full amount has not been paid - I was told that it is possible that my ex might have been off sick, for example. If that is the case, I would get less, as they have to allow him a certain amount to live off, by law. They wrote to the employer asking why the amount received was reduced, but the CSA did not tell me the reason, quoting data protection. In my case, the reduced payments just meant that it will take him a bit longer to pay off the arrears that he owes.
