Help problems with holiday pay after Mat leave

My OH is due to return to work on Monday after 12 months on Mat leave, 6 months full pay 3 months SMP 3 months unpaid leave, during the 9 months of paid leave OH had holiday pay which she opted to sell at end of Mat leave to pay for 1st months child care, the only other option was to have extra days off at the end of the 12 months. She called the HR department today to ask for actual figure and was in for a shock they have no record of it so not actioned:eek: OH was present when her manager put this request in and Manager has emails from HR, they have said she can have the money if a new request is put in but will be paid end of Feb, she can also apply for advance of wages but they will not pay this until 15/02. We have budgeted for the last 12 months taking into consideration this money would be available for the nursery fees (£600)

We are really stuck nursery is all organised and DD due to start on monday when we also have to pay the £600 month in advance, if we dont pay the nursery OH can not return if we pay the nursery the mortgage wont get paid and a number of other bills. The employers sugggestion was to borrow the money until they can sort it out!

Can they do this? Is there anything we can do?

    Yes they can and probably not much you can do about it other than make a complaint about the system which still does not get you the money. Manager filling in the required form in front of her is not the same as manager sending it to the correct person in HR/Payroll or that person passing it along the chain of required people.

    Payroll/HR have systems and without the correct forms being filled in and approved by the various people it can not be actioned. Many also have complicated computer systems for payroll with specific payment dates and unless information is inputed before a specific date it can not be paid until the next pay date.

    Depending on the size & policies of the company though they may be able to make an emergency loan but many do not give this information out freely. I got one years ago when my tax code went bonkers one month and was left with next to no pay. Has to be paid back of course.
  • Thank you its the civil service, the manager has an email from HR advising it had been actioned. We really dont know what to do other than default on bills etc.

  • So complain asap, enclosing a copy of that email and requesting either payment as agreed or an emergency loan until it can be paid.
