References following employment tribunal

I resigned from my last employer and took them to an employment tribunal (and won) and there ended up with a lot of bad feeling all round. My employer was severely criticised by the tribunal for their conduct. Prior to leaving I had recieved a glowing written reference from them (don't ask...long story!)

My question is how likely do you think a future employer would be to accept a copy of this written reference, or are they more likely to want to write to my previous employer themselves for a reference (a new reference from them now is unlikely to be so glowing following the tribunal!!!!!)

    They have to be truthful so if you had a glowing reference in relation to your work they cannot change this. However they can also state you took them to tribunal!
  • Most prospective employers will ask if they may contact your last/current employer you then have the option to say no i would rather you didnt and then explain why alternatively if they dont ask then tell them you would rather they didnt contact your previous employer tell them you took them to a tribunal and they would attempt to scuttle any attempts for you to gain another position probably give you more credit for being honest.

    IMO most Employers won't just accept an already produced written reference, as it could be fake. They're more likely to write/phone the Employer and ask them to reiterate and/or confirm you worked there, and the reason for leaving.

    But as you resigned, I don't see a problem, it's not as though you were fired, and after going through a tribunal I can't see your previous Employer lying on a reference.

    I don't agree with the previous post that you should say to any future Employers they can't contact your previous Employer as that wouldn't really impress them.

    I was informed by a friend, that employers can access some kind of permanent record that can inform them if you have been through a tribunal.

    I told my friend that I didn't think this was correct but he was adamant that it was and was apparently informed so by the CAB. I still maintain he was miss informed but I am not sure, any one know? :question:

    As others have said it is unlikely that any prospective employer will just accept the previous reference and will want to contact your ex-employer directly, but you should explain the details fully to any prospective employer and perhaps provide a transcript of the Tribunal decision as background.

    Tribunal proceedings are a matter of public record and each office will maintain records that are open to search by the public. It will only reveal that a John/Joan Smith was involved in a case against XYZ Limited, it will not have details such as your date of birth or address to identify you further as a CRB record would. So unless you have a very distinctive name it is unlikely that anyone making other than the most determined investigations would find out that you had been to a Tribunal.
