Dismissal from job - can we do anything?

My husband had been working for a company for 6 months and had passed the date of his 6 month probation period (his contract did not state that the appointment needed to be formally confirmed, just the date he started and 6 month probation). His boss called him to a meeting and dismissed him on the grounds that there was not enough work to support the number of staff, that he should leave immediately and they would pay one weeks notice in lieu. Since then he has found out that his position has been filled - probably by someone with less experience that they can pay less.

I realise that since he was there under one year he cannot claim unfair dismissal. His employer followed no disciplinary procedure and there has been nothing in writing. I am not sure if there is a statutory requirement for this.

It just seems very unjust...are there any terms for unfair/wrongful dismissal here?

    Unfortunately, no. Your husbands Employers haven't done anything unlawful. Within the 1st year of Employment you can be dismissed from your job at any time and even without an explanation (the only time you could take action is if the dismissal is pregnancy, discrimination related). I'd advise your husband to get down to the Job Centre and sign on for JSA. Good Luck!

    You have no recourse to an Employment Tribunal for the reason you state, too little service. The employer has terminated the contract and is therefore in breach, but as your husband was probably paid some lieu in notice it is unlikely that you have a claim. Even if you did you would have to go to an ordinary court, as the amount of damages is not likely to be large enough to justify the time and expense. -- Sorry
