settlement agreements

Am i as an employee within my rights to request that i will not agree to a settlement if it contains - that i may not work in the same industry for a certain period of time.

I would accept confidentiality.

If the above was included i would find it very hard to find alternate employment.

If this was the case would i be better to go for an unfair dismisall claim?

    Is this a compromise agreement? If so, then use the compulsory legal advice that your employers must pay for and get the agreement checked out for things like any restrictive clauses.

    BTW, you HAVE to accept confidentiality if it is a CA. But then again, so do they - so they can't tell anyone exactly why or on what terms you left.

    I think you have the right to work for a living, so any restrictions must be fair.
  • I understand that it is a legal document and that advice will be needed.

    The company have not yet agrred to enter negotiations as of yet.

    I am not sure if i need a settelment or a compensation agreement as it is being discussed on the grounds that i have been unfairly dismissed/made redundant.

    Restrictive covenants as they are called are extremley hard to enforce and hardly worth the paper they are written on. What industry are you in? Negotiate it out if you can.
