Reclaiming motgage penalty charges

Hi,
In the news today the FSA has fined a mortgage company for charging excessive fees for missing mortgage payments, and is ordering them to repay the charges to customers, it also sayes other lenders are in the frame for the same treatment, my question is this, does anyone have any futher info on this subject as it appears to be a uturn, we challanged unfairly high charges on our mortgage in 2007, with kensington mortgage company, the complaint went all the way to the financial ombudsman service who found the charges were fair, even though kensington were charging us £40 arrears fee, £20 missed DD fee, £25 for contents insurance (even though we had a live policy) plus interest every month we were in arrears, that does not seem to be fair in my view, any thoughts on this ?.
