P45 Incorrect

I recieved my P45 and last pay slip in the post today. I have been on the emergency tax code throughout my temporary employment. I am owed around £180 in tax..the P45 states £120. I was tazed £60 on this months pay slip. They haven't taken this months tax into account.

Do I contact the employer or tax office or both? Will they have sent a copy to the tax office? Are they able to issue more new P45's? I'm new to this tax situation so it's quite confusing.

    If you have been paying emergency tax then I should speak to the HMRC directly (they are friendly) - contact the address on your P45 (they will be listed). I guess it depends on how long you have worked on the temporary contract - if its a month then yes, you would probably pay emergency tax but if longer one would have thought that you would be taxed properly and not via an emergency code.

    I don't think you will be issued with another P45 though but you need to check with the HMRC and see what they say about your tax situation and how it can be rectified.

    The purpose of a P45 is to enable a new employer to operate PAYE correctly. If you are on "emergency" (or week/month 1) the errors that you refer to will not affect that.

    The old employer will have sent a copy to the tax office and at the end of the tax year will include you in their summary, hopefully with the correct figures. You can, if you wish, check the details with HMRC.
  • I was working there for 2 months. They put me on emergency tax. I tried to sort it several times. Tax office even contacted them a few weeks before my last pay but they still didn't change it over.

    The amount earned to date is also incorrect on the P45 too. You don't think I will be issued with a new one? Surely I would need a correct one for proof when I need to claim back the emergency tax?

    I rang the employer but apparently the lady that deals with pay is off for a few weeks. Very helpful. I'll contact the tax office and see if they have a correct one but I doubt it if mine is incorrect. Hopefully they will help :)

    If you were on emergency tax the figures on the P45 are irrelevant for reclaiming tax paid in that employment. The tax office will sort it out, but you may need to press them to do it, and it possibly (probably) won't happen during this tax year.

    Are you sure? The P45 should show exactly what was earned and how much tax was paid in that employment, regardless of whether the tax was a regular code, BR or Month1.

    xwelshyx is alleging that the P45 does not show these correctly, which means if she takes another job and gets a proper tax code, she will still not be correctly taxed.

  • I am still having problems with my P45. I've sent a letter off to the Next store I worked at, the head office and the tax office. I sent photocopies of my payslip and P45, showing that the information was incorrect. I'm owed £180 tax but the P45 was only taken up to a month before I finished working there, therefore is incorrect.

    What can I do? Am I just going to have to accept that I will only get the £120? As they don't seem to want to rectify the problem.

    I'm currently on job seekers and haven't handed the P45 over because it's incorrect. If the P45 was correct then I could have had my tax return by now.

    If anyone could offer any advice that would be great :)

    Your P45 refers to the previous tax year so the JC can't repay this anyway.

    I really think that you need to send a stern letter to your tax inspector with photocopies of the payslips and the P45 showing that the tax is incorrect and requesting a refund. Send a copy to the employer as well. Perhaps even take the letter to the nearest HMRC enquiry office and see if they can deal with it or at least give you a receipt for it to be sent to the correct office.
