I recently posted a thread and it has been deleted.
Not moved..............not closed.................DELETED
I am about to lose my house which will be closely followed by the loss of contact with my children..........................and ALL thanks to the CSA
The reason is.............My CSA payments have been TREBLED
why??????
only one reason.....
I've been "migrated" from CSA1 to CSA2
why??????
only one reason.....
Ex-wife has produced an ILLEGITIMATE child (please note, NO USE of the "B" word) ! So, presumably no further deletion of this thread lmfao
On CSA1 they take into account ones mortgage costs (in my case £1,200 per month)
On CSA2 they do not.
So to sum up..................I am about to lose my home (which I was forced to buy in order to house my 2 devoted kids for the obligatory 1 night in 14) TOTALLY due to a court order.........
"In the best interests of the children"?????
I don't think so.
Does anyone have ANY idea how I could battle this on a financial level (MSE's ethos) ??
the following are facts..............
(1) The family courts act "in the best interest of the children"
(2) CAFCASS act "in the best interest of the children"
(3) The CSA act "like a bunch of !!!!s and certainly NOT in the best interest of the children"
Why is this? Anyone?
Why is the CSA so anti "in the best interest of the children" and why is the CSA so pro PWC 'at any cost' ???
The CSA is a national disgrace

I would suggest that in order to receive constructive replies, you edit your post to focus on the facts of your situation. At the moment it just looks like a big old rant against the CSA.Gone ... or have I?0

I read your thread, though didn't comment on it even when it was obvious people were struggling to realise the new child of your exs was not yours.
Your ex could have thought what you paid towards your own was insufficient. Maybe she could cope until a new father did the same. Maybe she wanted more from both of you. Who knows!
Past is past and reasons are reasons - it doesn't matter whether they are morally right or wrong as it will never change the csa situation.
The fact is, she can close your csa1 case and open it 13 weeks later under csa2 to increase the payments.
What you need to focus on to get help is the amount of arrears and how much you have avoided paying. Also is the csa forcing a sale or is it just you have over-committed yourself due to hoping csa1 would always apply?0 -
If it is under the CSA forcing the sale of teh house, then there are things that you can do to counter this action that are with in the law and a Judge has said will stand in a Court!
You will need to get sight of a copy of teh 'White Book' to but one is over £1000, this book contains the Civil Procedure Rules that goven the actions of the Court. You will need rule 73 and there is a lot of it, not all is on the web site! Try 73.9 as well as 73.4.2. These points give the power back to the Court.
However if it is a matter of the amount that they take then try to talk to your MP.
